our terms and conditionsThe general terms and conditions regulate the contractual relationship between Tabasam Tours and Safaris Ltd (hereinafter referred to as the “Company”) and you (hereinafter referred to as the “Guest”).
By booking a service or using the Company’s website, the Guest acknowledges that they have read, understood, and agreed to these Terms and Conditions. The Company encourages the Guest to review these Terms carefully before confirming any booking.Bookings and Reservations
All bookings may be made directly through our official website, by phone, or via authorized travel partners. A booking is confirmed once we receive the required deposit or full payment and issue a confirmation email or invoice.
Each confirmed reservation represents a binding contract between Tabasam Tours and Safaris Ltd. and the Guest named on the booking.
It is the responsibility of the Guest to review all booking details and notify the Company immediately of any inaccuracies.
Failure to report discrepancies may affect the validity of your booking.
Payments and Deposits
We accept payments via bank transfer, credit/debit card, cash payments, or other approved payment methods listed on our website.
Booking Requirements:
Zanzibar-based tours: Bookings accepted up to 2 days before the tour start date.
Safari/Mountain Hiking tours (Tanzania mainland): Bookings must be completed no later than 3 weeks before the tour start date.
Deposit Requirements:
A deposit of 35% of the total tour cost is required to secure your booking, regardless of chosen payment method.
For online payments: Full payment or 35% deposit can be processed immediately via our secure payment provider.
For cash payment arrangements: The 35% deposit must be completed online via credit/debit card to confirm and secure your booking, with the remaining balance payable in cash upon arrival or at the tour meeting point.
If a payment fails or a card is declined, the Company will notify the Guest immediately.
The remaining balance for cash payment bookings is due no later than the date arranged by the Company before the start date of the tour or upon tour commencement.
Failure to complete any required payments (deposit or remaining balance) within the agreed timeframes may result in automatic cancellation of the booking without refund of any payments made.
Changes and Cancellations by The Guest
Booking Modifications: Guests wishing to modify confirmed bookings must contact the Company in writing via email at booking@tabasamtours.com or through WhatsApp messaging to +255 778658865. All communications must include the booking reference number.
Short-term changes to confirmed bookings (e.g., number of participants, travel dates, accommodation preferences) may incur additional costs depending on the nature and timing of the requested change.
Automatic Cancellations:
Bookings will be automatically cancelled if payment attempts fail or are not completed within the specified timeframes.
Guests will receive automatic email notification of any automatic cancellation.
Pending bookings that remain unpaid will receive reminder emails containing cancellation options.
Manual Cancellations: Guests wishing to voluntarily cancel confirmed bookings must notify the Company in writing via email at booking@tabasamtours.com, including their booking reference number.
Cancellation Fees:
50% of the tour price for cancellations made less than 24 hours (for Zanzibar tours) and 3 weeks or less (for Safari/Mountain Hiking tours) before the start date of the respective tour.
All cancellation confirmations will be sent via email to the Guest's registered email address or through Whatsapp messaging.
Refunds, if applicable, will be processed within 14 working days from the date of confirmed cancellation.
All booking contracts are legally binding and governed by the laws of the United Republic of Tanzania.
Changes and Cancellations by The Company
The Company reserves the right to cancel or reschedule tours due to circumstances beyond its control, including but not limited to inclement weather, natural disasters, political instability, or insufficient bookings.
In such cases, the Company will offer the Guest an alternative date, comparable tour, or full refund.
The Company is not responsible for expenses or losses resulting from changes or cancellations, including visa fees, flights, or accommodation not booked through the Company.
Weather and Unforeseen Events
Certain tours, such as safaris, snorkeling, or mountain treks, are weather-dependent. In the event of unfavorable weather conditions, the Company may modify, postpone, or cancel activities for safety reasons.
Where possible, the company will reschedule the tour or offer an alternative experience of comparable value. Refunds are issued only when rescheduling is not possible.
Guests must follow instructions from guides, drivers, or other Company representatives at all times. Participation in these activities is at the Guest’s own risk, and the company is not liable for injuries, accidents, or personal damages.
Force Majeure and Legal Protection
Force Majeure means, in relation to the business of the Company, all circumstances beyond the company’s control (including floods, thunderstorms, fires, accidents, threats of war, sabotage, riots, civil disturbances, epidemics and quarantine, government intervention, weather conditions, or other external events).
If affected, the Company will inform the Guest immediately of the nature and extent of the event. The company cannot be held liable in such cases. In rare cases where a third party (e.g., hotel or lodge) fails to perform, the Company will endeavour to provide compensation.
Travel Documents:
Guests are responsible for ensuring that their travel, vaccination, and visa documents comply with regulations of their home country and the United Republic of Tanzania.
The Company is not responsible for damages resulting from failure to meet entry requirements.
Luggage:
The Company is not responsible for lost or damaged luggage or personal effects.
Special baggage limits may apply for mountain hikes and domestic flights; details will be provided upon booking.
The Company cannot accept liability for stored luggage at its offices.
Customer Special Requests
The Company strives to accommodate special requests, such as dietary requirements, mobility assistance, or medical considerations. Requests must be submitted in writing at least 7 days prior to the tour.
While the Company will make reasonable efforts to fulfill such requests, they cannot be guaranteed and do not form part of the contractual agreement.
Third Party Services and Recommendations
The Company does not provide airline ticketing services or general accommodation booking services.
The Company may provide recommendations for flights and accommodations as a courtesy to assist guests with travel planning. However, such bookings must be made directly between the Guest and the respective service providers.
For specific tour packages, accommodation may be included as part of the contracted services. When accommodation is included, it will be clearly specified in the tour description, and confirmed booking details will be provided to the Guest.
The Company is not responsible for any issues, modifications, cancellations, or disputes arising from flights, accommodations, or other services that are not explicitly included as part of the confirmed tour contract. Guests remain solely responsible for confirming all third-party arrangements and ensuring such bookings align with their contracted tour dates and requirements.
Safety and Health
Safety is a top priority. Guests must follow the instructions of their guides or Company representatives at all times.
Guests are responsible for ensuring that they are physically fit and medically capable of participating in the selected tour or activity.
Comprehensive travel insurance covering medical emergencies, accidents, loss of property, and cancellations is recommended.
Participation in activities such as swimming, snorkeling, hiking, or mountain climbing is at the Guest’s own risk.
Behaviour and Code of Conduct
Guests are expected to behave respectfully toward other participants, staff, and the environment. Disorderly, abusive, or dangerous behavior may result in removal from the tour without refund.
Consumption of alcohol or drugs affecting safety is strictly prohibited during any tour or activity.
The Company reserves the right to refuse future service to individuals who violate this code of conduct.
Photography and Media
During tours, the Company may take photographs and videos for promotional use on its website, social media, or marketing materials.
By participating in the tours, the Guest grants Tabasam Tours and Safaris Ltd. the right to use their image, likeness, or voice in such media without compensation.
If the Guest prefers not to be photographed or filmed, they should notify their guide or Company representative prior to the tour or upon being asked for consent during the tour.Complaints and Dispute Resolution
Guests are encouraged to notify their guide or the Company office immediately if an issue arises so it can be resolved promptly.
If unresolved, formal written complaints may be submitted within 7 days following the tour. The Company will respond within 14 working days.
Disputes will initially be handled amicably through negotiation before resorting to legal action.
Email Communication and Marketing
By booking with Tabasam Tours and Safaris Ltd., guests receive transactional emails related to their reservation, payment, or itinerary.
Guests may also receive occasional updates, special offers, or newsletters. They may unsubscribe from promotional emails at any time via the unsubscribe link or by contacting the company directly.
Data Protection and Privacy
Personal information collected during booking is used solely for communication and service delivery.
The Company does not share personal data with third parties except as necessary to fulfill the booking (e.g., hotels or transport providers).
All data is managed in accordance with international data protection standards. Guests may request correction or deletion of their data at any time by contacting the Company.
General Terms
All website content, images, and materials are owned by Tabasam Tours and Safaris Ltd. and protected by copyright law.
The Company reserves the right to update or amend these Terms at any time without prior notice. The latest version will always be available on the website.
Participation in tours constitutes acceptance of these Terms.
